What did she forget about the fingertip until she was "reminded" by the other lawsuit? Sounds like another frivolous lawsuit inwhich an innocent party has to pay to represent themselves.
I really wish there was so sort of law reform that makes the guity party pay for legal costs. I know, I know, this is not a popular thought in the US (I'm ready for the tomato throwing :D ) but I just think it would make people think twice about alleging some crime took place when it didn't.

I am in total agreement with you, you don't have to think what everyone else may think, we are still free here to express our own
opinion and the world doesn't have agree.
This country is plumb lop-sided with it's political correctness or
with the bashing of other's opinion, when it isn't agreeable with what
is now is considered progressive thinkers.
The laws are being made in favor of the criminals, not the victims.
Time for a reversal of thinking. If someone is guilty of inventing
lies for any reason, falsely accusing someone else, in order to be given money, they should be prosecuted for telling this lie.
I loved Wendy's chili, we were eating there, with take-out food often.
Well, that woman ruined, the pleasure of eating there. We don't now.
There should be a punishment for the lawyers, that take such a case,
in hopes of gains too.

The article stated that she didn't file sooner because she didn't know the extent of her damages...
I haven't eaten Wendy's chili since the famed finger incident, but I wasn't really keen on the way the chili was made and kept BEFORE that happened. (food poisoning waiting to happen)
If people KNEW what happened in restaurant kitchens, NO ONE would eat in restaurants. You just have to trust that you've eaten enough dirt and have a good immune system. A sense of humor that runs to the macabre might help, too.

Lol, at you MBrogier, what you say is so true. Every time, I go to
a popular take out chicken place, originated in N.O., they have help
wearing those fake long fingernails, if I think of it, later eating,
I almost upchuck. Sure will help you lose weight, mind over matter.

Another solution is that if you win your case, you are only entitled to the compensatory damages, not punitive damages.
compensatory = an attempt to make whole the plaintiff for the injury/crime.
punitive = Big money = a charge levied against the person committing the act in order to make sure they learned their lesson. These fines usually increase the larger the defendant is....
So as it stands today, a person who had their leg broke by a careless commercial driver might collect several thousand in compensatory damages for their broken leg, and hundreds of thousands in order to "teach" the company to be more careful training their drivers. This gives a _profit_ motive to bringing forth a lawsuit.
I say give the punitive charges to a relevant charity...for example that woman who got the tens of millions for spilling her McDonalds coffee should have had the punitive charges applied to a children's burn unit instead... or even to the general tax fund....but not to her personally. That person should only be entitled to be "made whole" after the incident, not profit from it.
Oh, and BTW, I told you this would be a media wave. This happens _all_the_time....

The problem with this is that while it does "punish" those people who bring blatantly frivolous suits, it also hurts the people who bring legitimate claims that just don't happen to win them. And since there are already sanctions against parties AND their attorneys for bringing blatantly frivolous, harassing, etc. suits, I don't we'll be seeing that change in our justice system anytime soon. And I have to say that I'm happy about that.
Personally, I like Escher's scheme a lot better. :)

This is creepy! People are finding fingers all over the place!!! Someone should alert the authorities. There must be hundreds of people out there missing digits! People just walking around amongst us with sawed off fingers! It is a conspiracy, if you ask me!
Whew. Just checked. I have all ten of mine. How about you?
